What TikTok is really asking you to accept

We ran the public TikTok Terms of Service through Sneaky Terms, the same analysis you get for your own contracts. Terms change, so check the current version at the source. This report reflects the document as of July 10, 2026.

Freddie Fox

Freddie's verdict

You keep making the videos and TikTok keeps a license to use them that does not end when you walk away. Your account can be suspended without notice, and the most they may owe you is about one hundred dollars.

Some clauses need attention

TikTok Terms of Service

terms of service19 clauses

This review assumes you are the user. This is TikTok's Terms of Service for the U.S., governing your use of the TikTok platform, including content creation, sharing, AI features, and commerce. It covers what TikTok can do with your content, how disputes are handled, and what liability TikTok accepts.

Key issues found

  • TikTok gets a broad, irrevocable license to your content
  • You must sue within 1 year or lose your rights forever
  • Liability capped at $100 even for serious harm
  • You pay TikTok's legal costs if anything goes wrong

Trap (3)

TrapLiability

Liability Capped at $100

TikTok's maximum payout to you for any harm is $100. That's it.

The Fine Print

the maximum aggregate liability of TikTok USDS Joint Venture and our affiliates, service providers and business partners ... shall, under no circumstance, exceed the greater of $100 or the amount you have paid us in the past 12 months.

In Plain English

If TikTok causes you harm, the most you can recover is $100 or whatever you paid them in the last 12 months, whichever is higher. Since most TikTok users pay nothing, this effectively caps your recovery at $100. This applies no matter how serious the harm: a massive data breach exposing your personal information, wrongful account termination that destroys your business, or any other damage. Combined with the exclusion of consequential damages, this means TikTok has almost zero financial accountability to you.

Real World Example

You're a creator who earns income through TikTok. A platform error wrongfully bans your account for 3 months, costing you thousands in lost sponsorship deals and revenue. The maximum TikTok owes you under these terms is $100.

What You Can Do

Consider understanding that if TikTok causes you significant financial harm, your recovery is essentially limited to $100; plan your business reliance on the platform accordingly.

TrapLiability

No Liability for Personal Injury or Property Damage

TikTok says it's not responsible if you get hurt using their platform.

The Fine Print

WE SHALL NOT BE LIABLE TO YOU FOR ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU AS A RESULT OF: ... PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE PLATFORM

In Plain English

TikTok disclaims liability for personal injury or property damage resulting from your use of the platform. While this is framed as a general disclaimer, it is extremely broad. If a TikTok challenge promoted by the algorithm causes physical harm, or if a product purchased through TikTok Shop causes injury, TikTok claims no responsibility. This attempts to eliminate a fundamental protection.

Real World Example

You buy a product through TikTok Shop that turns out to be defective and causes an injury. TikTok points to this clause to argue they bear no liability for the harm, leaving you to pursue the seller directly, who may be overseas and unreachable.

What You Can Do

Consider that this disclaimer may not hold up in all situations; laws vary by country, and a local lawyer can tell you exactly where you stand.

TrapLiability

No Liability for Consequential or Indirect Damages

TikTok won't pay for lost income, reputation damage, or lost data. Period.

The Fine Print

Under no circumstance will TikTok USDS Joint Venture or our affiliates, service providers, or business partners ... be liable under these Terms, whether in an action in tort (including negligence) or contract or otherwise for any punitive, consequential, incidental, exemplary or special damages

In Plain English

This clause eliminates TikTok's responsibility for virtually every type of real-world damage you could suffer. Lost profits from a wrongful ban? Not covered. Reputation damage from TikTok's error? Not covered. Lost data? Not covered. Lost business opportunities? Not covered. Even if TikTok knew their actions would cause you these losses, they still claim no liability. For creators and businesses that depend on TikTok for income, this means the platform has no financial accountability for the actual harm it could cause.

What You Can Do

Consider diversifying your income sources and not relying solely on TikTok if you are a creator or business, since TikTok accepts no liability for the real financial harm of platform disruptions.

Sneaky (8)

SneakyYour Rights

Broad, Irrevocable License to Your Content

Once you post it, TikTok can use your content forever, even to train AI.

The Fine Print

By creating, inputting, publishing, and otherwise providing Your Content on or to the Platform, you grant to TikTok USDS Joint Venture a license to use Your Content that is: non-exclusive, irrevocable, and royalty-free

In Plain English

When you post anything on TikTok, you give them a permanent, worldwide license to use it however they want for their platform and technology development. The word 'irrevocable' is the key problem here: even if you delete your account, TikTok keeps the right to use your content. They can also hand this license to their partners and sub-contractors through 'multiple tiers' of sub-licensing. Notably, this includes using your content to train their AI and machine learning models, meaning your videos, images, and text could become training data for TikTok's AI products indefinitely.

Real World Example

You post an original dance routine that goes viral. You later delete your account and want to license the routine exclusively to a brand. TikTok still has an irrevocable license to your content and could continue using it in their AI training data, promotional materials through partners, or other platform features.

What You Can Do

Consider being selective about what you post, as there is no way to revoke this license once content is uploaded.

SneakyYour Rights

Perpetual License to Other Users Too

Every TikTok user gets permanent rights to copy and remix your content.

The Fine Print

Depending on your Platform usage, including your sharing activities and settings, you also grant to each user of the Platform a non-exclusive, royalty-free, perpetual and irrevocable, worldwide license to use Your Content

In Plain English

Beyond TikTok itself, every other TikTok user also gets a perpetual, irrevocable license to your content. This means any user can copy, download, remix, and redistribute your content, and that right never expires. Even if you delete your video, anyone who already interacted with it retains the right to keep using it. The phrase 'depending on your Platform usage, including your sharing activities and settings' suggests some control, but the default sharing settings are broad.

Real World Example

You create an original comedy sketch. Another creator downloads it, edits it into their own video, and monetizes it. Because you granted every user a perpetual, irrevocable license, you have no legal basis under these Terms to demand they stop or share revenue.

What You Can Do

Consider reviewing your sharing and privacy settings carefully before posting, as the default settings grant very broad rights to other users.

SneakyYour Rights

One-Year Deadline to File Any Legal Claim

You have only one year to sue TikTok, then you lose that right forever.

The Fine Print

YOU AND TIKTOK USDS JOINT VENTURE AGREE THAT YOU MUST INITIATE ANY PROCEEDING OR ACTION WITHIN ONE (1) YEAR OF THE DATE OF THE OCCURRENCE OF THE EVENT OR FACTS GIVING RISE TO A DISPUTE THAT IS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM.

In Plain English

This clause cuts the time you have to bring any legal claim against TikTok down to just one year. Many types of legal claims normally have longer time limits. If you miss this one-year window, you permanently lose the right to take any legal action, no matter how serious the issue. The all-caps formatting is a classic tactic for burying important terms in text that people tend to skip over.

Real World Example

TikTok's platform has a data breach that exposes your personal information. You don't discover the breach until 14 months later. Under this clause, your right to take legal action is permanently gone, even though you had no way of knowing about the breach sooner.

What You Can Do

Consider noting the date of any incident with TikTok carefully; if something goes wrong, you could consult a lawyer promptly to avoid missing this tight deadline.

SneakyLiability

Sweeping Indemnification Obligation

If TikTok gets sued because of your posts, you pay their legal bills. No cap.

The Fine Print

You agree to defend, indemnify, and hold harmless TikTok USDS Joint Venture and our affiliates, service providers, and business partners ... from any and all claims ... arising out of or relating to your use of the Platform under these Terms

In Plain English

This means you agree to pay for TikTok's legal defense, settlements, and any damages if anyone sues them over something connected to your use of the platform. This covers an extremely broad list of entities: TikTok, their affiliates, business partners, officers, directors, employees, agents, and advisors. The obligation survives even after you delete your account. There is no cap on how much this could cost you, and it is entirely one-sided since TikTok does not offer you the same protection.

Real World Example

You post a video using a song you believed was royalty-free. The music rights holder sues TikTok. Under this clause, TikTok can demand you cover their legal defense costs, settlement payments, and attorney fees, even if TikTok's own music library suggested the song was available.

What You Can Do

Consider that this is a one-sided, uncapped obligation; you could consult a lawyer if you plan to use TikTok for any commercial or high-profile activity.

SneakyYour Data

Your Content Used to Train AI Models

Your videos and posts become training data for TikTok's AI systems.

The Fine Print

for the purposes of operating, improving, and providing the Platform and developing new technologies (including training, testing, and improving our machine learning models and algorithms)

In Plain English

Buried within the broader content license, TikTok explicitly states they can use your content, including videos, images, text, and AI inputs, to train and improve their machine learning models and algorithms. This means your creative work becomes raw material for TikTok's AI products. Because the license is irrevocable, you cannot later opt out of having your content used this way for content already uploaded.

What You Can Do

Consider checking your Platform settings for any AI-related opt-out options, and be mindful that content already posted may already be in training datasets.

SneakyTheir Power

Account Ban Without Notice at Sole Discretion

TikTok can ban you anytime, no warning, no reason needed.

The Fine Print

We reserve the right, at any time and without prior notice, to ban or suspend your account, or restrict your access to features of the Platform, at our sole discretion, including if: we have reason to believe in our sole discretion that you have violated these Terms

In Plain English

TikTok can ban or suspend your account at any time, without warning, and based entirely on their own judgment. The phrase 'at our sole discretion' appears twice, meaning there is no objective standard they need to meet. While they do offer an appeal process, the initial action can happen instantly and without explanation. For creators who depend on TikTok for their livelihood, this is a significant risk.

Real World Example

You're a creator with 500,000 followers and active brand deals. TikTok's automated system flags your account for a suspected violation. Your account is banned without warning. While you wait for the appeal process, your brand deals fall through and your audience moves on.

What You Can Do

Consider keeping backups of your content and maintaining a presence on other platforms, so a sudden ban does not wipe out your work.

SneakyTheir Power

TikTok Can Change Terms Without Advance Notice

TikTok can change these rules and you agree just by continuing to use the app.

The Fine Print

Where we need to make urgent changes, for example, for security, safety, legal or regulatory reasons, we may not be able to provide you with advance notice, but we will let you know as soon as we are reasonably able to do so.

In Plain English

While TikTok says they will generally notify you of material changes, they carve out a broad exception for 'urgent changes' covering security, safety, legal, or regulatory reasons. These categories are vague enough to cover almost any change TikTok wants to make quickly. The clause also says they will let you know 'as soon as we are reasonably able to do so,' which is entirely at their discretion. Combined with the next paragraph that says continued use means acceptance, TikTok can effectively change the rules on you without meaningful advance notice.

What You Can Do

Consider periodically reviewing the Terms of Service page, especially after receiving any notification from TikTok about updates.

SneakyTheir Power

TikTok Can Freely Assign the Contract

TikTok can sell your contract to another company without telling you.

The Fine Print

Our rights and obligations under these Terms are freely assignable by us without any requirement to notify you or any third party, in connection with a merger, acquisition, sale or disposition of assets ... or by operation of law or otherwise.

In Plain English

TikTok can transfer this entire agreement, including all the rights you granted them over your content, to any other company without telling you. The word 'otherwise' at the end makes this essentially unlimited. Meanwhile, the same section states that your rights 'may not be transferred or assigned by you.' This is a one-sided arrangement: TikTok can hand off your relationship to anyone, but you are locked in.

What You Can Do

Consider being aware that a future corporate transaction could mean a completely different company holds all rights to your content under these terms.

Watchful (8)

WatchfulYour Rights

Feedback Becomes TikTok's Property

Any idea you share with TikTok becomes theirs, free of charge.

The Fine Print

If you choose to submit comments, ideas, or feedback to us, you give us permission to use them in connection with the Platform and any other services that we choose, for any purpose, without any restriction or compensation to you.

In Plain English

If you suggest a feature or share an idea with TikTok, they own anything they build from it. You get no credit, no compensation, and no confidentiality. This is fairly common in tech company terms, but it means you should never share a valuable business idea through TikTok's feedback channels.

What You Can Do

Consider never submitting valuable or proprietary ideas through TikTok's feedback channels.

WatchfulYour Rights

Your Name and Image Used in Ads Without Pay

TikTok can use your name and face in ads for free.

The Fine Print

To enable these features, you give us permission to use your name, profile image and username, in connection with ads, sponsored gifts, offers, and other branded or sponsored content that you interact with, without any compensation to you

In Plain English

When you like, comment on, or interact with sponsored content, TikTok can use your name, profile picture, and username in connection with that advertising. TikTok gets paid by advertisers for this, but you get nothing. Essentially, your engagement becomes a free endorsement that TikTok monetizes.

What You Can Do

Consider being mindful about which sponsored posts you interact with, as your engagement could be used as an endorsement.

WatchfulYour Rights

Exclusive Venue in California Courts

You must travel to Los Angeles to sue TikTok, no matter where you live.

The Fine Print

Any claim, cause of action or dispute, arising out of or relating to these Terms or the Platform shall also be resolved exclusively in the U.S. District Court for the Central District of California or the Superior Court of the State of California, County of Los Angeles

In Plain English

If you need to take legal action against TikTok, you must do it in Los Angeles, California. If you live in New York, Florida, Texas, or anywhere else, you would need to travel to California and hire a California lawyer. This creates a practical barrier that discourages most users from pursuing legitimate claims.

What You Can Do

Consider that this venue requirement significantly increases the cost of any legal action; factor this into your risk assessment.

WatchfulLiability

Comprehensive Warranty Disclaimer

TikTok makes zero promises that the platform works or is safe.

The Fine Print

We and TT COMMERCE & GLOBAL SERVICES, ALONG WITH EACH'S AFFILIATES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ADVISORS, DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED

In Plain English

TikTok disclaims every possible warranty about the platform. This means they make no promises that the platform works properly, is fit for any purpose, or does not violate anyone's rights. While warranty disclaimers are standard in free consumer services, the breadth here is notable, especially given that TikTok also operates a commerce platform (TikTok Shop) where product quality matters.

What You Can Do

Consider that TikTok accepts no responsibility for platform reliability; do not rely on it as your sole business or communication channel.

WatchfulLiability

AI Output Provided With No Guarantees

If TikTok's AI gives you bad info, that's your problem, not theirs.

The Fine Print

Output is provided "as is" and is made available to you without any representations or warranties of any kind, whether express or implied. You are responsible for your Input and your use of Output, and for all consequences resulting therefrom

In Plain English

TikTok's AI features come with zero guarantees. The output could be wrong, misleading, or worse, and you bear all the consequences. If TikTok's AI generates something defamatory or infringing and you share it, you are on the hook, not TikTok. This is becoming standard for AI features but is worth understanding.

What You Can Do

Consider always verifying AI-generated content before sharing or acting on it.

WatchfulLock-in Tactics

Surviving Obligations After Account Deletion

Deleting your account does not end your obligations under these terms.

The Fine Print

If you delete your account, these Terms (as may be amended) will terminate as an agreement between you and us, except for obligations that remain in place which by their nature should survive the termination of these Terms ... Section 3.5 "Ownership of content and grant of licenses,"

In Plain English

Even after you delete your account, many of the most important sections of these Terms continue to apply to you. This includes TikTok's irrevocable license to your content, the liability limitations, your indemnification obligations, and the dispute resolution rules. Deleting your account does not free you from these commitments.

What You Can Do

Consider understanding that the content license and indemnification survive account deletion; there is no clean break from these terms.

WatchfulTheir Power

Username Can Be Reclaimed After 180 Days

Don't log in for 6 months and TikTok can give away your username.

The Fine Print

We may revoke, reclaim, and/or reassign the username of your account in certain circumstances, such as, when you have not logged into your account for 180 days, if we ban your account

In Plain English

If you do not log in for 180 days, TikTok can take your username and give it to someone else. For creators who have built a brand around their username, this could be damaging. The 180-day inactivity threshold is relatively short.

What You Can Do

Consider logging in periodically even during breaks to protect your username.

WatchfulTheir Power

Content Removal at TikTok's Discretion

TikTok can delete any of your content, public or private, for any reason.

The Fine Print

We may remove or restrict access to any content, including yours, whether publicly or privately posted, for any reason, including if (a) it violates these Terms, our Community Guidelines, or other conditions or policies

In Plain English

TikTok can remove any of your content, including private messages, for broad reasons. While content moderation is necessary, the phrase 'for any reason' gives TikTok essentially unlimited discretion. This applies to both public and private content.

What You Can Do

Consider keeping copies of important content outside of TikTok.

Missing protections (6)

No Data Deletion or Portability Rights

The Terms do not specify what happens to your data after account deletion. There is no mention of a right to download all your data, a timeline for data deletion after account closure, or a commitment to actually delete (rather than anonymize or retain) your personal information. The Privacy Policy may address some of this, but the Terms themselves are silent, leaving you without a contractual right to data removal.

Suggested language

Upon account deletion, TikTok shall delete all personal data associated with the user's account within 30 days, except where retention is required by law. TikTok shall provide a data export tool allowing users to download all personal data and content in a commonly used, machine-readable format prior to account deletion.

No Refund Policy for Purchases

TikTok operates TikTok Shop and sells virtual items (coins, diamonds), but these Terms contain no refund policy. The Virtual Items Policy and TikTok Buyer Policy are referenced but not included. Without seeing those documents, you have no contractual guarantee of refunds for defective products, unauthorized purchases, or virtual items you did not receive.

Suggested language

Users shall be entitled to a full refund for any virtual items not delivered, any unauthorized purchases, and any physical goods purchased through TikTok Shop that are defective, not as described, or not delivered within the stated timeframe. Refund requests shall be processed within 14 business days.

No Guaranteed Timeline for Appeal of Account Bans

While TikTok mentions an appeal process for account bans, there is no guaranteed timeline for reviewing appeals. A creator whose livelihood depends on the platform could be banned and left waiting indefinitely for a response. Without a defined timeline, the appeal right is weak.

Suggested language

TikTok shall acknowledge receipt of any account ban appeal within 48 hours and shall provide a substantive response, including the specific reason for the ban and the outcome of the appeal review, within 14 business days of receipt.

No Notification of Content Removal Reasons

TikTok can remove content for broad reasons but the Terms do not require them to tell you specifically why your content was removed or which rule it violated. Without specific notice, you cannot meaningfully adjust your behavior or appeal effectively.

Suggested language

When TikTok removes or restricts access to user content, it shall notify the user within 24 hours, specifying the particular content affected, the specific rule or policy violated, and the user's right to appeal the decision.

No Price Change Notice for Paid Features

The Terms reference subscription services, virtual items, and TikTok Shop but contain no requirement for advance notice before price changes to any paid features or services. TikTok could increase prices for subscriptions or virtual items without warning.

Suggested language

TikTok shall provide users with at least 30 days' advance written notice before any price increase to subscription services, virtual items, or other paid features. Users shall have the right to cancel any affected subscription without penalty before the price increase takes effect.

No Service Level or Uptime Commitment

There is no commitment to platform availability or uptime. For users and businesses that rely on TikTok for income, extended outages could cause significant financial harm, and TikTok has no obligation to maintain service or compensate for downtime.

Suggested language

TikTok shall use commercially reasonable efforts to maintain Platform availability of at least 99.5% uptime on a monthly basis, excluding scheduled maintenance. In the event of unscheduled downtime exceeding 24 consecutive hours, TikTok shall provide affected users with a pro-rata credit for any paid services.

Frequently asked questions

Who owns the videos you post on TikTok?

You do. The terms say that, apart from TikTok's own content, you own what you create and upload. The catch is the license that comes with posting. You grant TikTok broad rights to use, copy, adapt, and share your content, including to train its machine learning models.

Can TikTok keep using your videos after you delete your account?

Yes. The license you grant is irrevocable, and the terms list the content license section among the obligations that survive account deletion. Deleting your account ends the agreement but not the rights you already granted. Content that other users have built into their own posts can also stay publicly visible.

Can TikTok ban your account without warning?

Yes. The terms let TikTok ban or suspend your account, or restrict features, at any time and without prior notice, at its sole discretion. You can appeal through the app, but the terms do not promise any timeline for a decision.

How much can you claim from TikTok if something goes wrong?

The terms cap TikTok's total liability at the greater of $100 or the amount you paid TikTok in the past 12 months. Most people use the app for free, so in practice the cap is about $100. The terms also say TikTok will not pay for lost profits, lost reputation, or lost or corrupted data.

Can you take TikTok to court?

Yes, but on TikTok's terms. You must first go through an informal resolution process, where the side receiving notice of a dispute has 60 days to respond before either side can file. Any lawsuit must then be brought in specific state or federal courts in California, no matter where you live, and you must start any claim within one year of the event or it is permanently barred.
